Experienced Federal Prosecutor Andrew Hull Returns to Hyman, Phelps & McNamara, P.C. After Six Years Enforcing FDA, DEA, and Healthcare Laws

Washington, D.C., March 5, 2025 – Hyman, Phelps & McNamara, P.C. is pleased to announce the return of Andrew Hull to the firm, bringing with him invaluable experience gained over the past six years as federal Department of Justice (DOJ) prosecutor investigating and litigating cases in the life sciences and healthcare space. Mr. Hull will bolster the firm’s litigation and regulatory compliance practices, representing clients facing government investigations, enforcement actions, and whistleblower complaints, while also providing strategic counsel on risk mitigation and regulatory compliance.

As an Assistant U.S. Attorney (AUSA) in the Western District of Michigan, Mr. Hull was the Affirmative Civil Enforcement Coordinator and the Healthcare Fraud Coordinator in the office’s Civil Division. In this role, he spearheaded False Claims Act (FCA) qui tam investigations and enforcement actions, handled parallel criminal-civil healthcare prosecutions, and successfully tried multiple criminal cases to jury verdict. His deep understanding of government enforcement mechanisms uniquely positions him to defend clients facing criminal, civil, and administrative enforcement actions.

Mr. Hull’s work as a federal prosecutor comprised multiple cases involving the FDA-regulated industry. These include negotiating a consent decree with an infant formula manufacturer at the height of the 2022 infant formula shortage crisis, litigating an FCA case against a device manufacturer involving reuse of single-use and single-user products, conducting the parallel criminal-civil prosecution of a urogynecologist and his practice for Medicare fraud and adulteration of medical devices, and obtaining a criminal jury verdict as a part of the trial team prosecuting a gray market supplier of diabetic test strips under the Strengthening and Focusing Enforcement to Deter Organized Stealing and Enhance Safety Act of 2012 (SAFE DOSES Act).

In this role, Mr. Hull also brought civil enforcement cases under the Controlled Substances Act, including negotiating a consent decree and $1 million penalty with an addiction treatment network and two of its officers, obtaining a court order prohibiting a pharmacy alleged to have dispensed illegitimate prescriptions from future dispensing, and resolving numerous cases with practitioners for alleged unlawful opioid prescribing.

Mr. Hull also focused on complex healthcare fraud cases as an AUSA, co-leading the Western District of Michigan’s parallel prosecution of practitioners involved in telemedicine fraud schemes involving genetic testing and orthotic braces and resolving a multi-million-dollar settlement with a toxicology laboratory and its corporate ownership for billing Medicare for allegedly medically unnecessary urine drug tests.

As a litigator, Mr. Hull’s experience trying cases in federal court and before the Drug Enforcement Administration’s Office of Administrative Law Judges enables him to expertly guide clients through all phases of federal investigations and, if necessary, aggressively defend them in court. He has successfully negotiated numerous complex settlements, leveraging his in-depth knowledge of life sciences and healthcare regulations to obtain favorable outcomes for clients interacting with the DOJ, FDA, DEA, Department of Health and Human Services (HHS), and Centers for Medicare & Medicaid Services (CMS).

Beyond his litigation experience, Mr. Hull counsels clients on compliance with FDA and DEA regulations across the food, drug, and device supply chains. He assists clients with inspection-readiness training, developing best-in-class compliance programs, and responding to administrative actions to mitigate risk and ensure regulatory adherence.

Prior to his tenure as a federal prosecutor, Mr. Hull was an associate at Hyman, Phelps & McNamara, where he advised clients on regulatory matters. He began his legal career as a law clerk to DEA Chief Administrative Law Judge John J. Mulrooney, II, a prestigious position he obtained through the Department of Justice’s Attorney General’s Honors Program.
